By creating an account or using the MIST platform, you agree to these Terms of Service. MIST is a product of Imaginary Sales LLC, a Missouri limited liability company ("we," "us," "our"). If you're using MIST on behalf of a business, you represent that you have authority to bind that business.

MIST is an AI-powered outreach platform. We provide tools to:
We do not guarantee any particular business outcome from using the platform — response rates, meetings booked, or revenue generated depend on your offer, contacts, and market.
You must provide accurate information when registering. You are responsible for keeping your login credentials secure. You are responsible for all activity that occurs under your account.
One account per person or business entity. You may not share accounts or resell access without our written permission.
You agree to use MIST only for lawful outreach. You must not use the platform to:
We may suspend or terminate accounts found violating these rules without notice.
You own your contact lists. By uploading contacts to MIST, you represent that you have a lawful basis to contact those individuals (e.g., existing business relationship, legitimate interest, or consent).
You are the data controller. We process your contact data on your behalf as a data processor. See our Privacy Policy for full details.
MIST charges per pipeline run at the rate shown on your account at time of purchase. Prices may change with 30 days' notice.
Subscription plans (if offered) are billed in advance on a monthly or annual cycle. Payments are processed by Stripe. You authorize us to charge your payment method on file.
Refunds: We offer refunds within 7 days of a charge if you have not run any campaigns in that billing period. After campaigns have been run, charges are non-refundable. Contact billing@imaginarysales.com for billing disputes.
You may cancel your account at any time. Cancellation stops future charges. Access continues until the end of the current paid period. We do not prorate partial months.
To cancel, use the billing portal in your dashboard or email billing@imaginarysales.com.
The MIST platform, soul agent characters, quality gate logic, and all underlying technology are owned by Imaginary Sales LLC. These terms do not grant you any ownership rights in the platform.
You retain ownership of the content you upload (contact lists, campaign briefs) and the messages drafted through the platform on your behalf.
MIST is provided "as is" and "as available." We make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or that AI-generated content will be accurate or suitable for your purposes.
To the maximum extent permitted by law, Imaginary Sales LLC's total liability to you for any claim arising out of or relating to these terms or the platform is limited to the amount you paid us in the 90 days preceding the claim.
We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or data, even if we have been advised of the possibility of such damages.
You agree to defend, indemnify, and hold harmless Imaginary Sales LLC and its officers, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your use of the platform, your violation of these terms, or your violation of any third party's rights.
We may update these terms. Material changes will be communicated by email at least 14 days before taking effect. Continued use of the platform after the effective date constitutes acceptance. The current version is always at imaginarysales.com/terms.html.
These terms are governed by the laws of the State of Missouri, without regard to conflict of law principles. Any disputes will be resolved in the courts of Jackson County, Missouri.
